Verification of Employment Contracts
WHAT IS THE PURPOSE OF CONTRACT VERIFICATION?
The Labor Attache will check and ensure that the employment contracts of the Filipino migrant workers are consistent with the prevailing employment laws, standards and practices in both the Philippines and the host country and that the documentary requirements for overseas employment as required by the Department of Migrant Workers (DMW) are complied with.
The verified employment contract shall also be presented to the DMW BM Centers in the Philippines as a requirement for the issuance of OECs and it may be required by the Philippine Immigration Officers in the Philippines prior to departure.
WHO NEEDS TO HAVE THEIR EMPLOYMENT CONTRACTS VERIFIED?
- Filipino workers who are registered with DMW and have changed employers onsite.
- Filipino nationals working abroad without DMW records.
- Filipino nationals with prospective employers whose employment Visa was approved by the Immigration Department.
What are the Requirements?
CONTRACT RENEWAL
- 2 sets of Original Standard Employment Contract
- Copy of Employer’s HK ID with contact number written on the same page
- Copy of Domestic Worker’s HK ID with contact number written on the same page
- Original and Photocopy of the domestic worker’s passport
- Printed copy of the New Employment E-Visa

CHANGE EMPLOYER
- 2 sets of Original Standard Employment Contract

Contract Verification for Filipino Foreign Domestic Workers (FDW)
WHAT IS THE PROCESS FOR DOMESTIC WORKERS?
(Not Applicable for new hires)
- Submit documentary requirements to the Migrant Workers Office WINDOWS 1-5
- Pay Verification fee (See schedule of fees below)
- Submit OWWA Information Sheet to COUNTERS 6-8
- Pay OWWA membership fee, if the membership is expired or about to expire (See schedule of fees below)
- Your verified employment contracts will be ready for pick-up on the same day at COUNTERS A and B
Contract Verification for Skilled / Professional OFWs
ON SITE VERIFICATION
(workers who are not registered with the DMW or who change employers on site)
PRESENTLY EMPLOYED SKILLED WORKER (already at the jobsite)
- Duly stamped and signed new/valid employment contract corresponding the worker’s visa with a minimum basic wage of at least HK$ 42.1 per hour (1 original copy)
- The terms and conditions of the employment contract must include repatriation of human remains and insurance coverage (medical and/or life insurance).In case repatriation and insurance coverage are not indicated in the employment contract, the worker will be required to have his/her contract amended to reflect the prescribed terms and conditions or to submit an addendum to the employment contract indicating repatriation and insurance coverage.
- In case the basic wage is below HK$ 42.1 per hour, the worker will be required to have his/her contract amended to reflect the prescribed minimum basic wage
- Valid passport of the worker (1 copy) (valid for at least 6 months)
- Valid employment visa of the worker (1 copy)
- Valid Business Registration of the employer or Company Profile (1 copy)
- Any additional proof of employment (1 copy), such as:
a.) Current certificate of employment, duly stamped and signed by the employer ( valid within six months from date of issuance).
b.) Valid company ID
c.) Recent 3 months pay slips, duly stamped and signed by the employer - Additional requirements for Enhanced Labor Supplementary Labor Scheme (ESLS) visa holders:
a.) Application Form for workers hired through ESLS
b.) Employer’s Undertaking
- Duly stamped and signed new/valid employment contract corresponding the worker’s visa with a minimum basic wage of at least HK$ 42.1 per hour (1 original copy)
DIRECT HIRE (Worker’s still in the Philippines)
- Duly stamped and signed new/valid employment contract corresponding the worker’s visa with a minimum basic wage of at least HK$ 42.1 per hour (1 original copy)

- All documents must be complete and correct to avoid delays.
- Compliance resubmissions follow the same review cycle.
- Email notifications serve as official communication for next steps.
Repatriation Clause :
“In the event of death of the employee during the terms of this agreement, his remains and personal belongings shall be repatriated to the Philippines at the expense of the employer. In the case the repatriation of remains is not possible, the same may be disposed of upon prior approval of the employee’s next kin and/ or by the Philippine Embassy/ Consulate nearest the jobsite.”
WHAT IS THE PROCESS FOR SKILLED / PROFESSIONAL WORKERS
- Submit documentary requirements to the Migrant Workers Office Office WINDOW 11 for evaluation (Mon-Thu / 9am – 11am, 1pm – 3:30pm)
- Pay Verification fee on the date of release (See schedule of fees below)
- For workers who are not registered by the Department of Migrant Workers (DMW) or who changed employers on-site, present your Verified employment contract to the DMW upon your return/vacation in the Philippines in order to process your OEC.
